Assemblymember Diane Dixon of Newport Beach issued a statement regarding Assembly Bill 379, which focuses on increasing penalties for those convicted of purchasing minors aged 16 and 17 for sex. The bill initially aimed to align penalties with existing laws that protect children aged 15 and younger. However, Dixon noted that the bill was diluted by Democrats, prompting Republican colleagues to raise concerns.
Dixon explained, “After facing significant backlash, the majority party listened and worked on amendments to address our concerns.” Despite voting in favor of the measure in the Committee on Appropriations, she acknowledged there is still more work needed. She pointed out that the new language does not ensure all victims receive equal protection under a felony penalty.
She highlighted issues such as when a minor aged 16 or 17 is solicited by someone within three years of their age, it remains an aggravated misdemeanor. Furthermore, if prosecutors cannot prove that the defendant knew or should have known the person was a minor, it becomes a standard misdemeanor.
Dixon emphasized the need for stronger protections: “It is still wrong and illegal to have sex with a minor. Minors cannot consent to sex.” She expressed her commitment to continue working on this issue.
